Health and Safety (Offences) Act 2008

 

This Act installed a new Schedule 3A into the Health and Safety at Work Act 1974. As is the case with the extracts below, most offences now have the potential for a term of imprisonment following summary conviction.

Failing to discharge a duty under

sections 2-6 or contravening a Regulation.

 

 

A fine up to £20,000 and/ or a term of imprisonment not exceeding 12 months.

 

A fine and/or a term of imprisonment not exceeding two years.

 

Failing to discharge a duty under

section 7.

 

A fine up to the statutory maximum and/or a term of imprisonment not exceeding 12 months.

 

 

A fine and/or a term of imprisonment not exceeding two years.

 

Contravening an enforcement notice.

 

A fine up to £20,000 and/ or a term of imprisonment not exceeding 12 months.

 

A fine and/or a term of imprisonment not exceeding two years.

 

Section 36 and 37 offences

 

A fine up to £20,000 and/ or a term of imprisonment not exceeding 12 months.

 

 

A fine and/or a term of imprisonment not exceeding two years.
